Definitions:
The parties to the agreement:
The term “purchaser” is used of the physical person who is acting mainly as a private person and who, by giving an order to the Martinus Institute makes an offer to purchase specific items and have them dispatched to you.
“The Martinus Institute” is used in the following both of the physical or legal person who accepts the purchaser’s order by sending an order confirmation, and sells the ordered items, and of the homepage on which the items are presented and from which they are ordered.
Product information:
The Martinus Institute can inform you of the specifications of the items. For further information or questions regarding existing information please send an e-mail to the Martinus Institute: info@martinus.dk.
Prices:
All prices are current ones and are valid only on the day of ordering. Prices are subject to alteration. All prices include 25% VAT.
Ordering:
The presentation of items along with a price in the Martinus Institute’s net bookshop is not a binding offer, but merely an invitation to make an offer.
The purchaser’s order of items from the Martinus Institute does not constitute a binding acceptance from the Martinus Institute, but a binding offer to the Martinus Institute to purchase the items under the conditions mentioned. An agreement between the purchaser and the Martinus Institute is not binding until the Martinus Institute accepts the purchaser’s offer by sending a mail confirming your order.
Payment:
The account information you key in when buying items will be sent directly to PBS (automatic funds transfer) in an encrypted form (SSL) that only you and PBS can read. No one else sees or stores information about you. When purchases are paid for by Dankort or a credit card, the sum is withdrawn from your account as soon as the items are dispatched from the Martinus Institute.
Risk of unforeseen damage or deterioration
The purchaser is responsible for any unforeseen damage or deterioration to the ordered items only from the moment when the ordered items have come into the purchaser’s possession.
Complaints:
In compliance with the Danish Sale of Goods Act the Martinus Institute will refund the full purchase price for up to two years from the invoice date if your purchase has any defect or deficiency as to materials or workmanship. The right to claim compensation for a defective product does not cover defects, damage or wear and tear arising directly or indirectly as a consequence of wrong use, poor maintenance, brute force or unauthorised interference.
The invoice shall be presented to the Martinus Institute when making a complaint. Any complaints about faulty products that have been delivered shall be made to the Martinus Institute within a reasonable time after the purchaser has or should have discovered the fault.
Please indicate - and, on request, point out - the nature of the fault.
Exemption from liability and guarantee:
The seller is not liable to pay compensation to the purchaser for direct or indirect loss as a consequence of the late arrival of ordered items, or as a consequence of the ordered items being faulty, when the delay or faults are due to actions or omissions on the part of the purchaser that lie outside the Martinus Institute’s control, for example, war, revolt, unrest, fire, intervention by the state, confiscation, currency restrictions, industrial disputes of any sort, including strikes, lockouts and the like.
Right of cancellation:
If the customer informs the Martinus Institute within 14 days of delivery that he/she has regretted his/her purchase, the Martinus Institute will refund the amount received when the purchased items have been returned. Items that are returned without postage or by cash on delivery will not be accepted. Please use PostDanmark when returning items from within Denmark not alternative package distributors. This makes it possible to trace the item if it is lost during return mail. You should pack return items well, enclose a copy of the invoice, state clearly that you want to make use of your right of cancellation and that you therefore would like to have the purchase price of the item refunded. We recommend that you return the item as a package marked “handle with care”. You can also regret your purchase and deny receipt of the package. These rules for returning items are valid for all items sold as distance selling to private persons; they are not valid for items sold to companies.
The right to make changes:
The Martinus Institute reserves the right to make changes and update the rules and conditions that are valid for this website. It is therefore important that you keep yourself up to date with any changes.
Date of delivery:
Unless otherwise stated for individual items the expected date of delivery is within 14 days in Denmark.
Abuse:
Abuse of the Martinus Institute’s web shop will be prosecuted.
